Legal Showdown: Texas Nursing Homes Challenge Federal Staffing Mandate

In a significant legal move, the American Health Care Association (AHCA), the Texas Health Care Association (THCA), and several long-term care facilities in Texas have filed a lawsuit against the U.S. Department of Health and Human Services (HHS) and the Centers for Medicare and Medicaid Services (CMS). Filed in the Northern District of Texas, this lawsuit contests the recently finalized Minimum Staffing Standards for Long-Term Care Facilities rule, arguing that it exceeds CMS’s statutory authority and imposes unrealistic staffing requirements.

Industry Leaders Speak Out

Mark Parkinson, President and CEO of AHCA, expressed his disappointment, saying, “We had hoped it would not come to this; we repeatedly sought to work with the Administration on more productive ways to boost the nursing home workforce. Unfortunately, federal officials rushed this flawed policy through, ignoring the credible concerns of stakeholders and showing little regard for the negative impact it will have on our nursing home residents, staff, and the larger health care system. We cannot stand idly by when access to care is on the line and federal regulators are overstepping their authority. Hundreds of thousands of seniors could be displaced from their nursing home; someone has to stand up for them, and that’s what we’re here to do.”

Derek Prince, Board Chair of THCA and CEO of HMG Healthcare, added, “Hundreds, if not thousands, of nursing homes are at risk of closure over this federal staffing mandate, and nowhere is that truer than in Texas. Our state’s nursing homes notoriously lack proper Medicaid funding, a key factor in whether a nursing home can comply with this mandate. More than two-thirds of Texas facilities cannot meet any of the new requirements, and the state’s anticipating a growing shortage of nurses. We must protect access to care for elder Texans and seniors across the country.”

Legal Arguments and Economic Impact

The lawsuit asserts that the new rule departs from existing statutory standards, imposing a quantitative, one-size-fits-all approach rather than a qualitative, context-sensitive standard. Plaintiffs claim that the decision to adopt these standards was arbitrary and capricious, violating the Administrative Procedure Act. The economic impact is also a significant concern, with estimates suggesting the mandate could cost facilities over $5 billion annually, potentially driving closures and displacing residents.

AARP’s Stand: Defending the New Standards

In response to the lawsuit, AARP has mobilized its resources to defend the new staffing standards. Speaking at a White House event marking the end of Older Americans Month, AARP Chief Advocacy and Engagement Officer Nancy LeaMond vowed to fight “as hard now as we did over the years to get these [rules] over the finish line.”

LeaMond emphasized that the nursing home staffing standards, for the first time, require facilities to have enough staff to provide high-quality care. She called these standards “long overdue” and crucial for safeguarding the health and quality of life of vulnerable seniors. The AARP-backed standards, finalized by the Centers for Medicare & Medicaid Services this spring, are seen as essential steps to protect older Americans.

Panelists at the event, including licensed practical nurse Gabrielle DaSilva, highlighted the dire consequences of chronic understaffing. DaSilva shared stories of nursing home residents neglected due to insufficient staffing, emphasizing the urgent need for the new standards.
